The LGPD complies with the provisions of paragraph III, of article 3, of Law No. 12,965 of April 23, 2014 — Internet Civil Framework, which establishes principles, guarantees, duties and rights for the use of the internet in Brazil and its creation was mainly motivated by the numerous cases of personal data leaks at the national and international levels. The law is considered an important legislative framework in Brazil, placing the country on an equal footing with others that already had legislation on the subject. Companies that disrespect it will be subject to various penalties, for this reason the implementation of the LGPD has been a source of effort in companies today.
One of the most important contexts to pay attention to the implementation of the LGPD the labor environment is the priority in planning actions. This is because personal data is understood to mean information related to the natural person and considering that in labor relations there is a very large traffic of this information the implementation of the LGPD it is necessary for any company, not just large ones.
There are three main phases within labor relations, in which the employer processes the data of natural persons. The first is the recruitment process, and we detailed this phase in a previous article on the site. Then comes the phase of admission or formalization of a contract for the provision of services. And the third phase is the dismissal of the employee from the company's staff, regardless of the reason. Each of these phases has a specific flow of information, but in every employer, under the LGPD, it is classified as the operator and controller of the data, which makes it of paramount importance the appropriateness or implementation of the LGPD, since the employer is responsible for the data that will be transmitted to third parties, such as health plans, e-Social and insurance plans, for example.
At the time of implementation of LGPS, an internal mapping of these flows is recommended, aimed at analyzing the risks and real needs to comply with the law, which aims to guarantee more seriousness by companies in dealing with personal information, from the collection, storage, processing and deletion of data.
